A Los Angeles judge refused to accept her lawyer Mark Heller’s case that Lohan was unlawfully questioned by police following the 2012 car smash at a hearing yesterday and said the Liz & Dick star would still have to stand trial on March 18.
Lindsay is accused of violating the terms of her probation in her jewellery theft case by allegedly lying to police about the crash.
The 26-year-old actress told police she was not driving her Porsche which it smashed into a truck in Santa Monica in June and is accused of reckless driving, lying to authorities and obstructing the police in the aftermath of the accident.
She has pleaded not guilty to the charges.
Earlier this week the troubled star rejected a deal that would have required her to spend 30 days in rehab.
The Mean Girls actress faces three months to a year in prison on each charge if she is convicted.
She is also facing a separate charge following a nightclub scuffle in November.
